Please read these Terms and Conditions carefully before using our website or engaging our services. By accessing our website or instructing us to carry out work, you agree to be bound by these terms.

1. Our Services

Blue Butterfly Garden Design provides professional garden design, hard landscaping, soft landscaping, and related consultancy services across Doncaster and South Yorkshire. The specific scope, timeline, and costs of any project are set out in a separate written proposal and service agreement provided to you before work commences.

2. Consultations

Initial consultations are offered free of charge on an advice-only basis. We reserve the right to decline any enquiry or consultation request at our discretion. A free consultation does not constitute an agreement to provide services. A formal agreement requires a signed proposal and, where applicable, a deposit payment.

3. Quotes and Proposals

All quotes and proposals are valid for 30 days from the date of issue unless otherwise stated. Prices are subject to change after this period. Where VAT is applicable it will be clearly stated in your proposal.

4. Payment Terms

Payment terms are set out in your individual service agreement. Unless otherwise agreed in writing:

• A deposit is required before design or installation work commences
• Stage payments may apply for larger projects
• Final payment is due upon completion of work
• Invoices are payable within 14 days of issue
• We reserve the right to charge statutory interest on overdue invoices under the Late Payment of Commercial Debts (Interest) Act 1998

5. Cancellation and Variation

Should you wish to cancel or vary the agreed scope of work:

• Cancellation before work commences may result in loss of deposit
• Cancellation mid-project may incur charges for work completed and materials ordered to date
• Any variations to the agreed scope must be confirmed in writing and may affect price and timeline

Your statutory rights as a consumer under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013 are not affected by these terms.

6. Intellectual Property

All designs, drawings, plans, and creative materials produced by Blue Butterfly Garden Design remain our intellectual property until full payment has been received. Upon receipt of full payment, ownership of bespoke design materials transfers to you for personal, non-commercial use only.

All content on this website: including text, images, logos, and design: is the property of Blue Butterfly Garden Design and is protected by copyright law. It may not be reproduced without our written consent.

7. Limitation of Liability

To the extent permitted by law:

• We are not liable for any indirect, consequential, or economic loss arising from use of this website or our services
• Our total liability to you shall not exceed the total value of the contract between us
• We are not responsible for delays or failures caused by circumstances beyond our reasonable control (force majeure)

Nothing in these terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

8. Website Use

Our website is provided for general information purposes. While we take care to ensure accuracy, we do not warrant that the content is complete, accurate, or up to date at all times. Content may be changed without notice.

9. Privacy and Cookies
